Terms and conditions

These present conditions govern the sales of works and other products present on the site www.vincentdarnois.com.

The subscription to a contract governed by these general conditions with Mr DARNOIS VINCENT supposes the acceptance, by the Internet user, of all the general conditions. This acceptance will consist in the fact, for the Internet user, to tick the box corresponding to the following sentence: "I acknowledge having read and accepted the general conditions of sale".

ARTICLE 2 – THE CUSTOMER

The Customer declares to be a natural person, at least 18 years old and to have the legal capacity or to hold parental authorization allowing him to place an order on the vincentdarnois.com site.

When registering the customer's personal data during the purchase, the latter must ensure the accuracy of the mandatory data provided. In the event of an error in the recipient's contact details, Mr DARNOIS Vincent cannot be held responsible for the impossibility of delivering the product.

ARTICLE 3 – ORDER

Order taking on the vincentdarnois.com Site is subject to compliance with the procedure set up by Mr DARNOIS Vincent, embodied in a succession of different steps that the customer must imperatively follow to validate his order. The customer will have the possibility, before definitively validating his order, to check the details of it and its total price, and to correct any errors, before confirming it to express his acceptance. Any order confirmed by the customer constitutes a sales contract and acceptance of all the general conditions of sale.

A confirmation email summarizing the order (products, price, quantity, etc.) will be sent to the customer by Mr DARNOIS Vincent.

ARTICLE 4 – PRICE

The prices are indicated in euros and "All Taxes Included" (TTC). If the delivery takes place outside the territory of the European Union, the customs taxes and related formalities remain the sole responsibility of the consumer. The consumer then undertakes to check the conformity of the delivery with regard to the country of delivery.

Mr DARNOIS Vincent reserves the right to modify its prices at any time but the products will be invoiced on the basis of the prices in force at the time of the registration of the orders subject to their availability.

ARTICLE 5 - VALIDATION

When you click on the "Validate my order" button after the ordering process, you declare that you accept it and all of these General Terms and Conditions of Sale fully and without reservation.

The data recorded by the vincentdarnois.com site constitutes proof of all transactions made by Mr DARNOIS Vincent and his customers. The data recorded by the Paypal payment system and/or the payment service provided by the bank constitutes proof of the financial transactions.

ARTICLE 6 - AVAILABILITY

Our product offers are offered within the limits of available stocks. When a product is no longer available, it is displayed EXHAUSTED or SOLD OUT.

ARTICLE 7 - DELIVERY

Mr DARNOIS Vincent undertakes to deliver the products ordered within 15 days of the order. The products are delivered to the address indicated by the consumer on the order form. Any complaint must be addressed to the address vincent.darnois@gmail.com. In the event of non-compliance of the product delivered, Mr DARNOIS Vincent undertakes to exchange the product or to reimburse the consumer.

The consumer will check the general appearance of the packaging of the product delivered, in the event of damage, the recipient must request a report of spoliation or a report of anomaly from his deliverer. Once the package has been accepted by the recipient, it is considered to have been received in perfect condition, no complaint to Mr DARNOIS Vincent can be taken into account if the customer has not made any complaint to the delivery person.

In the event that a customer makes several orders separately, Mr DARNOIS Vincent reserves the right to pool orders within the same package.

ARTICLE 8 - PAYMENT

For each product offered for sale, the consumer has the choice of the following payment options:
- immediate payment by credit card
- payment by Paypal
The consumer certifies having the necessary authorizations to make the payment he chooses. In the context of payment by credit card, the payment order may be revoked in the event of fraudulent use of the card in accordance with the agreement concluded between the consumer and his banking establishment.

ARTICLE 9 – RIGHT OF WITHDRAWAL

The consumer has a period of 14 days to exercise his right of withdrawal from the day of receipt of the goods by the consumer, without having to justify reasons or pay penalties, with the exception, where applicable, of return costs.

ARTICLE 11 - INTELLECTUAL PROPERTY

All the illustrations and images reproduced on the vincentdarnois.com site are reserved under copyright as well as intellectual property and for the whole world. As such and in accordance with the provisions of the Intellectual Property Code, only use for private use subject to different or even more restrictive provisions of the intellectual property code. Any other use constitutes counterfeiting and is sanctioned under Intellectual Property without the prior authorization of Mr DARNOIS Vincent. Any total or partial reproduction of Mr DARNOIS Vincent's catalog is strictly prohibited.

ARTICLE 12 - RESPONSIBILITY

Mr DARNOIS Vincent cannot be held responsible for the non-performance of the contract concluded in the event of force majeure as defined by the courts (art. L-121-20-4 of the Consumer Code). In the event of non-performance of the contract resulting from the unavailability of a product, the consumer will be informed of this unavailability and may be reimbursed without delay and at the latest within thirty days of payment of the sums he has paid.

Mr DARNOIS Vincent cannot be held liable for damages of any kind, whether material, immaterial or bodily, which may result from the misuse of the items sold.

This agreement is subject to French law. The language of this contract is French. In the event of a dispute, the French courts will have sole jurisdiction.

ARTICLE 13 - PERSONAL INFORMATION

Mr DARNOIS Vincent undertakes not to disclose to third parties the information that you communicate to him. These are confidential. They will only be used by its internal services for the processing of your order.
